Note: Will: The Will of David Morden Uxbridge This is the last will and testament of David Morden of the Township of Uxbridge in the County of York in the Home District and Province of Canada Yeoman I will and devise that all my just debts funeral and testamentary expenses be paid by my Executors as soon as conveniently may be after my decease and as to my worldly estate wherewith it hath pleased God to bless me I give and dispose of the same as follows I give and devise to my beloved wife Mary Ann one good bed and bedding of her choice and what furniture and utensils she may think proper to choose and I give and devise to her the sole use of one room of her own choice in the dwelling house where I now dwell situate and being near the middle of Lot Number five in the first concession of the Township of Uxbridge also the use of the kitchen in communion with my youngest son Jacob All for the time of her natural life also I give and devise to my said wife annually one six of all the produce grown upon my farm being composed of the North half of Lot number four and all of Lot number five in the first concession of the said township of Uxbridge to be delivered to her in good marketable condition And I give and devise to my son James seventy five acres off the East end of said lot Number five in the first concession of Uxbridge subject never the less to the payment of the above mentioned annuity to my said wife and also to the conditions herein aforementioned And I give and devise to my son Jacob Seventy five acres more or less next adjoining that devised to my son James and al houses where I now reside subject never the less to the payment of the above mention annuity to my said wife and also to the above mentioned communion respecting the use of part of the dwelling house by my said wife and subject also to the conditions herein after mentioned I also give and devise to my daughter Mary Ann Now wife of John Keyster fifty acres more or less off the West end of Lot number five and twenty five acres more or less off the west end of the North half of Lot number four in the first concession of the said Township of Uxbridge subject never the less to the payment of fifty eight pounds fifteen shillings which she my said daughter Mary Ann received as part of her legacy some years since she being allowed however to pay the above mentioned out of her share of the live stock and other loose property in my possession at the time of my decease and by means here in after provided subject also to the payment of the above mentioned annuity to my said wife and also to the conditions here in after mentioned And I give and devise to my daughter Ellen wife of James Forsyth of Uxbridge the remaining seventy five acres more or less of the North half of Lot number four in the first concession of the said township of Uxbridge subject never the less to the payment of the abovesaid annuity to my said wife and also the conditions have in aftermentioned And I give and bequeath all my household goods (exception mentioned above) as also all the rest of my personal estate consisting of live stock, farming implements and other articles in my possession at the time of my decease share and share alike and likewise all property in possession of my said wife at the time of her decease to be equally divided in like manner And my will further is that the dividing of the farm as above mentioned that each one and all should have equal value as well as an equal number of acres of land and I therefore choose and appoint my trusty friends Samuel Bayer, Henry Cosby and Peter Shemfelt as my appraisers to set a value upon all and every parcel of my estate as above mentioned to be divided and I hereby require that those my sons and daughters receiving Hon conditions of law upon which the appraisers may set the highest value pay to those receiving the less valuable portions a due amount so that each and all may have share and share alike The above mentioned amounts to be paid out of or with the portions of loose property falling to the parties thus require to pay on otherwise as parties may agree And I nominate and appoint my trusty and worthy friends James Forsyth of Uxbridge and Jacob Morden my son to be executors of this my will hereby revoking all former wills In witness where of I the said David Morden have here unto set my hand and seal the ninth day of September in the year of Our Lord one thousand eight hundred and forty six
