Ky. b. 1785. His brother was named Benjamin. We believe his father was Enoch Berry who died in Hardin Co. Ky. 1808. We also believe there is a connection to your Joseph Berry but are having a hard time connecting the families. Since so many of the first names are repeated it seems to be a likely thing that there is some connection. Do you have a list of all of the children of Joseph? I need to look at my notes to review what I know about Joseph and Caroline Kercheval Berry. Let me know if you have an Enoch Berry with sons Samuel and Benjamin. Thanks, Judy Head ==== "Kate F. B." <rosadog99@@hotmail.com> Berry researcher Mary A. Berry B. 1828 was the daughter of Samuel Berry B. 1797 KY, and Elizabeth Davis born about 1801 KY. The connection may be that Samual Berry and Sarah Berry b 1804 KY were brother and sister. Sarah Berry then married Lewis Reno Rogers b. 1788, married 1828 (his second marriage). Later, like 1860. Elizabeth is found living with out Samuel, but Sarah Berry Rogers granddaughter is living with her. So, other than that I don't have a connection to Nancy and the Sarah and Lewis pair. Nancy may be the daughter of a brother of Lewis. I'll look in my paper stuff more and see if I can find anything else. I have been trying for ages to connect the Berry families. It seems that Samuel came from a family; Joseph Berry b. 1762 VA and Margaret Peggy Kercheval B 1761 VA. If you find anything out, please let me know. Sarah Berry B. 1804 has some paper trail, but not a solid connection to Joseph and Margaret. Thanks, I'll keep in touch. Kate Oh, Yes. Occupation farmer Brother: Benjamin (1757-1838) (not proven)
CHILDREN Son: Allen Berry (bef.1783-?) Daughter: Elizabeth Berry Hughes (bef.1785-?) Daughter: Nancy Berry Long (1783-1859) Daughter: Rachel Berry Smith (bef.1792-?) Son: Samuel Berry, Jr. (aft.1788-) Daughter: Mary Ann Allen Berry Daughter: Susanna Berry (bet.1794/1804-?) Son: James Berry (1798-aft.1850) Son: William Berry (bet.1794/1804-?)
Miscellaneous: By August of 1789, Samuel and Benjamin, probably his brother, appeared on the tax list of Fayette County, Kentucky. That same year, Woodford County was created out of Fayette, and Samuel was found no more on records from Fayette. In 1801, Lewis Craig sold 50 acres to Samuel Berry "of Woodford County."
On the 1810 federal census, a puzzle was suggested from the Woodford County names. Samuel Berry, Sr., was listed with five children and his wife. His oldest son, Allen, at least age 26, already had a separate home and a listing of his own. Benjamin had his wife and 10 children. Yet, there was another Samuel, written as "Jr.", but being over 45 years old. He could not be the son of either Samuel or Benjamin at that age.
On 4 October 1811, in Deed Book E, p. 331, the Berrys were involved in an unusual indenture. Evidently, Rachel Smith, the daughter of Samuel, Sr., had made a bad marriage. In order to take care of her, Samuel gathered together a group of men he trusted and sold to them for one dollar the following items needed to run Rachel's household: a female slave named Esther and her future increase (i.e., unborn children), one mare, a cow and calf, one feather bed, bedstead, and furniture, one desk, half a dozen earthen plates, half a dozen knives and forks, one cotton spinning wheel, one saddle and bridle, and all the household and kitchen furniture stores of provisions for family use not above enumerated. This group of men was made up of two neighbors, Randolph Railey and Chapman Taylor; Samuel's ?nephew?, Samuel Berry "(Ben's son)"; his own son, Allen W. Berry; and the unidentified Samuel S. Berry. In the indenture, these men agreed to allow Rachel Smith, Samuel's daughter, to possess and use all the enumerated items during her lifetime in order to provide her children proper and necessary support and education. She in turn would pay all the taxes and listen to their advice and direction concerning the disposal and management of the items. If Rachel died, the men would deliver the items to her heirs. The group of men had complete control of the upbringing and education of Rachel's children. The witnesses to this document were Benjamin Berry, Sr., James Berry, and Benjamin Berry, Jr.
Four years later, in 1815, the unidentified Samuel died in Woodford County. An inventory and appraisement of the estate of Samuel S. Berry, deceased, was found there (Will Book D, p. 284), having been made 9 February 1815 with Samuel Berry as administrator.
Samuel made his own will in 1809, he added a codicil in 1817 (his daughter, Rachel, was still having trouble with her husband), and it was proved in the May court of Woodford County in 1818. The will is included here.
Woodford CO Will Book F, p. 39: In the name of God amen I Samuel Berry of the County of Woodford and State of Kentucky being weak of body but of sound mind and memory do make and ordain this my last will and testament in manner and form following - I give and bequeath unto my loving wife MARY BERRY my house and tract of land with all the improvements thereon and on which I now live containing by estimation one hundred and seventy eight acres; also the whole of my negroes except two girls by name Esther and Hannah with all my stock of every kind and household and kitchen furniture to have and enjoy the whole of the above property during her natural life; but it is expressly my will and desire that my wife shall pay to my daughter SUSANNA in stock and furniture the sum of three hundred and twelve dollars at the time of marriage or her arriving at the age of twenty one being an equal proportion which my son ALLEN and my daughters BITSEY HUGHES and NANCY LONG have received from my estate. I give and bequeath to my daughter RACHEL SMITH the before mentioned negro girl Esther to her and the heirs of her body forever which makes her equal proportion. I give and bequeath to my daughter POLLY SMITH the before mentioned negro girl Hannah to her and the heirs of her body forever which makes her equal proportion. My will and desire is that my wife shall pay to my son SAMUEL two hundred and twenty three dollars when he shall arrive at the age of twenty one years to be paid in stock and furniture. My will and desire is that my wife pay out of my estate to my sons JAMES and WILLIAM the sum of three hundred and fifteen dollars each in stock and furniture to be paid to them when they shall arrive at the age of twenty one years. It is my express will and desire that all my youngest children that have not got their learning shall be educated out of my estate under the direction of my executors hereafter to be named. My will and desire is that the whole of my estate not before disposed of shall be equally divided after the decease of my wife between all my children that shall be then living and the heirs of those that may be deceased and if any of my children shall die without an heir my will and desire is that their part or parts shall be equally divided between all my children that shall be then living and children of those that may be deceased. My will and desire is that if my wife shall choose to pay off any of my children their parts in a negro, she is at full liberty to do so at their valuation. My wish and desire is that my wife, my sons Allen and Samuel, and my neighbor Randolph Railey be appointed my whole and sole executrix and executor to this my last will and testament. My express will and desire is that in case my wife should marry again that my said executrix and executor shall have my whole estate equally divided into three parts and allot to her one third part during her natural life and then her part to be equally divided between all my children that shall be then living and the heirs of those that may be deceased. In witness whereof I have hereunto set my hand and affixed my seal this 15th day of February one thousand eight hundred and nine.
Samuel (his mark) Berry Sn. Signed and sealed in presence of Sam'l Berry Jr, Chapman Taylor
Upon a reconsideration of the clause which relates to my daughter Rachel Smith, my will is that the negro girl Esther mentioned in said clause which I rated one hundred and fifty dollars shall now be rated at three hundred and fifty dollars. My reason for this is that I have had to pay debts of her husband John Smith to about the amount of that difference. In testimony whereof I hereunto set my hand and seal this 27th day of January one thousand eight hundred and seventeen.
