      In the Name of God Amen I James Claypole Senior of the County of Hardy and State of Virginia never being in Helth of Body and of Perfect mind and memory thanks be given unto God and calling unto mind the mortality of my Body and knowing that it is appointed for all men once to die do make and ordain this last Will and Testament that is to say Principally and first of all I give and recommend my soul unto the hands of Almighty God that Gave it and my body recommend to the earth to be Buried in decent Christian Burial at the descretion of my Executors Nothing doubting but at the general reserection I shall receive the same again by the mighty Power of God, And as touching such worldly Estate wherewith it has pleased God to bless me in this life I give Demure and dispose of the same in the following manner and form. First it is my will and I do order that in the first place all my just debts and funeral charges be paid and satisfied.

      ITEM I give to Jean McNees ye Daughter of my well beloved son William Claypool deceased five shillings to be paid out of my estate & I hereby debar her and her heirs from any further Right Title or Interest on my Lands Tenements Goods or Chattels.

      ITEM I give and bequeath unto my well beloved Son James Claypool my loom and all my Gears with the utensils belonging to her.

      ITEM I give my well beloved Son George Claypool the tract of Land and Tenements whereof he now lives on to him and his Heirs and Assigns forever the said Land I bought of John Denton and joins lines with David Wilsons Land.

      ITEM I give to my well beloved Son Jesse Claypool the tract of Land and Tenements whereof I now live on to him to his Heirs and assigns forever ye said Land I bought of James Thomas and was formerly a part of his tract.

      ITEM all the rest of my moveable Astate Goods and Chattels except as before excepted with the bond due me from Joshua Peppers Heirs for a tract of Land that I sold to ye said Joshua Pepper which Land William Pepper now lives on with all other Bonds Bills and Book Accounts whatsoever due to me I give and bequeath to my beloved Sons and Daughters (to wit) James Claypool, John Claypool, Joseph Claypool, George Claypool, Jesse Claypool, Mary Smith, Betty Ozborn, and Sarah Viney to be equally Divided between them. I allow my Goods and Chattels to be appraised and sold at Publick or Private Sale at the decree of my Executors. I likewise make and ordain my beloved Sons John Claypool and George Claypool Executors of this my Last Will and Testament and I do hereby utterly disalow revoak and disanull all and every other former Testaments wills Bequests and Executors by me in any wise before named will and bequethed Ratifying and confirming this and no other to be my Last Will and Testament. In Witness whereof I have hereunto set my hand and Seal this Seventeenth day of September in the year of our Lord One Thousand Seven hundred and Eighty Eight [Six].


      Signed Sealed Published Pronounced and Declared by the said James Claypool as his Last Will and Testament in the Presents of us who in his presents and in the presents of each other have herunto subscribed our names.

      At a court held for Hardy County the 7th day of December 1789 this Last Will and Testament of James Claypool Deceased was proved by the oaths of Jacob Denton and Tommie Thomas two of the witnessess thereto and ordered to be Recorded and on the motion of John Claypool and George Claypool the Executors therein named who made oath thereto acording to law Certificate is granted them for obtaining a probate thereof in due form giving security whereupon they with security entered into and acknowledged Bond conditioned as the law directs.

      Note: Largely taken from Bracken, volume, page 152, with one or two changes in keeping with Adrienne M. Griffis' version that appeared more likely.

      Griffis version was "transcribed by Barb Johnson from the original records in Hardy County, West Virginia."

      The only significant difference between the two is the date. Bracken gives the year as 1788. Griffis gives it as 1786. Griffis' copy has several ellisions and wordings that are different from the forms of the day, so I take Bracken's to be the more likely.

      DIED: 06 AUG 1823-IN THE 90TH YEAR OF HIS AGE

      CLAYPOOL, MARG'T - BORN: (1736)
      DIED: 26 MAR 1813-IN THE 77TH YEAR OF HER AGE

      On Wed June 23, 2004, Selma and I (JimB) went to the Miller Cemetery. I have photos of all 5 stones. The first two (from the left) are sufficiently defaced by the weather that I can't say what is inscribed on them. The remmaining three read:

      CLAYPOOL WHO WAS
      BORN SEPTEMBER THE
      26th 1733.AND DIED THE
      6th OF AUGUST 1823.
      IN THE 90th YEAR
      OF HIS AGE.


      IN MEMORY OF
      JAMES CLAYPOOL
      WHO DEPARTED THIS
      LIFE AUGUST 11 1811
      IN THE 81 YEAR OF
      HIS AGE

      IN*MEMORY*OF
      MARG'T*CLAYPOOL
      WHO*DEPARTED*THIS
      LIFE*MARCH*26*1813
      IN*THE*77*YEAR*OF
      HER AGE

      (The character I represented here as * is a little centered x.

      We return June 19, 2006 to find six graves, 4 of them with small modern markers at the base of the original stones. The "headstone" of the sixth grave looks to me to footstone of the grave next to it.

      June 20, 2006 we returned and Selma found a fallen stone several feet away from the row of 5 (now 6) Claypool stones. It reads

      JANE CLAYPOOL
      DECEAS'D
      JUNE 2 1768

      which agrees with Griffis' transcription above.

      Dr. Wilmer L. Kerns, Ph.D. records the family (in Historical Records of Old Frederick and Hampshire Counties, Virginia (Revised), 1988, 1992, ISBN: 1-55613-592-0) as:

      Claypool, James, was born Feb. 14, 1701 and died Oct 7, 1789. Jane Claypool, his wife, was born in 1701 and died 1788. James Clypool Jr. was born in 1730 and died 1811. John Claypool was born in 1733 and died 1823, Margaret Dunbar was born in 1736, and died in 1813. Source: Gravestone inscriptions in family plot, Hardy County, W.Va.
